They have physical control over the premises. The owner pays the property taxes.Out here a radio station leased land for a transmission tower, But the landlord stopped paying property taxes for whatever reason, and the county was set to seize the land and the tower. The radio station said that they could not seize the tower since that was regulated by the FCC. The court ruled that they could indeed seize the tower, that it was an improvement on the land, and belonged to the land. AFIK, the land was seized and the radio station pays rent to the county.
