A Mickey Mouse has unique features that identify it regardless of color. No-one can trademark a generic letter in a circle. What makes it unique to the MTA IS the color combination.Also see my other posts and the court cases I cited - if you made a blue Mickey Mouse to parody Disney in some way then it would be permissible. Still the bottom line is that the NY MTA went after someone who used SFMTA bullets, which are not trademarked. |
