Since these officers were acting outside the scope of their legitimate authority, what a judge would need to do if and when the verdict comes down against them is to specifically prohibit either the MTA, the NYPD or the City of NY from indemnifying the offending officers and make the officers pay out of their own pockets without any burden on the taxpayers whatsoever.

But are you certain that the NYPD, MTA, and City of New York are all 100% not at fault here? Because there has been a report posted here of an NYPD officer using a rule book that contained the pre-199X law of 1050.9(c) that stated that photography IS prohibited. If that officer was issued that book by the NYPD and was not issued a replacement, then the NYPD is at least partially at fault for him enforcing rules that are no longer in effect.
