Some comments:

Glad to see someone else has the balls to take on the NYPD, as they have been acting in a unprofessional manner in recent years.

I just got a phone call from a fellow railfan in NYC, who told me that the lawsuit was in the NY Daily News. I have not yet seen it. That is the best way to go, as government agencies can't stand bad press.

About public property: The MTA is a tax-funded state agency, and its facilities are in the public domain. They do have the right to make their own rules/laws, but cannot enact any statutes that would be in violation of the U.S. constitution.

As far as the lawsuit by RType3995 is concerned, it's more than just a case of harassment. This is a serious violation of one's civil rights! After being handcuffed, placed in a holding cell, and denied the use of toilet facilities, on trumped-up charges that were subsequently dismissed, he deserves to be compensated for this humiliation, which I'm sure he will be. This will send a strong message to other government agencies.

We should all be thankful that we live in the United States of America, as this is probably the only country where one can actually stand up and address their grievances without fear of retaliation and/or punishment. In the U.K., photographers' rights have just about been eliminated by government decrees.
