The reason the MTA dropped the original ban in the 1990's is because the NYCLU threatened to sue. MTA rescinded the ban rather than try to defend it in court.This time the city would not just be facing the NYCLU - as a result of the proposed MOFTB regulations there is now a very well organized coalition of civil rights groups, photographers, artists, freelance journalists and photojournalists that would challenge such a proposal. Legal fees for the MTA would pile into the millions regardless. |
