They can add a reversionary clause to the language granting the land to whatever entity administers the trail so if there is a crying need for it to return to rail it can be done without it being a taking. That said, it makes more sense to make a trail out of an unused ROW than to just let it sit with no benefit to anyone.your pal, Fred |
