They shouldn't have to pay a *DIME* as I've tried to illustrate in other threads ... If government can hold a copyright, then maybe we have ADDITIONAL rights to use the subway under FTC regulations for consumer fraud. OK, a bit far-fetched and TOO "strappie" but still ...Any COMPETENT lawyer has the argument that the BASIS of the "infringement" has no LEGAL merit at all. Bagels are NOT what you buy from a meatball card machine. The "towelheads" do NOT give rides (at least I hope not) ... so where is the ... "MARKET CONFUSION?" Those two words are the whole basis of the law ... that someone might be MISLEAD into buying from a fraudulent USER of another's property. Can ANYBODY tell me how they INFRINGED? :( |
