The real solution is to amend the CPLR to impose a high bar to clear to for negligence actions (maybe gross negligence has to be shown) and also a cap on total damages, with a provision that lets the state ask for attorney's fees if the plaintiff didn't make out his prima facie case.Fat chance of that ever happening.... |
