The MTA is failing to realize the small but crucial difference between a TRADEMARK and a SERVICE MARK. The lawyers for the shop could claim that these are service marks if they were never registered as trademarks with the federal government...and thus refuse to settle. If the shop can get the right lawyers, I think the shop could win the lawsuit. |
