If this officer came up to someone and (for the sake of argument), took something out of their purse and intentionally broke it, would that officer be "doing their job?"

No, on the contrary, unless they have a valid reason to seize the property (i.e. it is contraband or being used in the commission of a crime) they are acting in a manner utterly incompatible with their job description.

The law says that subway photos are NOT contraband. The law says that subway photos are NOT illegal. Nilet was NOT committing a crime when he took those photos.

Therefore the officer had absolutely zero justification in seizing and/or destroying Nilet's property. Yet the officer did so anyway, and quite blatantly and intentionally at that.

I really don't have a clue how I can make it any more elementary than that.
