Cuffing a person is an appropriate measure if the officer deems the person a threat to himself or others.The question is, did Nilet pose a reasonable risk to himself, to the officers or to others at the scene? Did he engage in abusive language, make aggressive gestures or threats, brandish a weapon or claim to have one, etc? If not, the use of handcuffs could be deemed an inappropriate use of excessive force. |
