Remaining outside the Capitol is similar to being at a protest outside the Barclays Center or Brooklyn Museum.

Not quite. There were police barricades making the Capitol steps off limits too. So it's some minor form of trespassing. But it's totally different from accompanying a crowd that had smashed doors to get inside the building.
