That may not have been possible from a legal and financial standpoint. Contracts such as those are done by evaluation of RFP, not strictly bid results and must be approved by the Board to be exempted from the usual bid process. There are usually options to these deals, and provisions for added costs, but once the original terms ran out, any attempt to sole source negotiate without a real good reason would end up in court. It was 10 years after the 160 deal, I'm sure enough new stuff was desired that would make any deal almost a new one price wise. Also, the funding came from the next 5 year plan. Would the Alstom shells from Brazil be desirable when BBD would fabricate in NYS (Plattsburgh) Remember, it takes upstate votes to get MTA money approved. |
