If you were criminally charged, of course that would be true. But the city made it a point not to do that. I'm sure there is a way a person could make himself a collar, but that is not what happens in the greatest majority of cases. They don't want to pay PD overtime, they don't want to pay the cost of processing, and they don't want the guilty to have a criminal record. I don't know what surrounding jurisdictions are doing, but that is the policy in NYC.
