Other states' laws and decisions are not binding precedent in New York or Federal Courts regarding New York cases. And as for dotting their Is and crossing their Ts, the Legislature, if the law is overturned, can simply point fingers at the Courts and they won't get blamed for writing a bad law, especially if they know there is no way to have it upheld. |
