When we factor out the emotion involved in the situation, employers generally have an obligation to provide a safe workplace, and if readily available equipment or procedures is/are available that can prevent an accident there may be an obligation on the part of the employer both to provide it, and to require its usage. This is a general statement, and there are variations in how it applies in specific industries and jurisdictions. Whether people are sympathetic or not is irrelevant to whether or not it is a valid case. It is not as far fetched a case as some may think. |
