Murder, no. Criminally negligent homicide is in the cards though. His actions being negligent in parking a truck on an RR crossing causing the collision when it would have been reasonable to believe that would be the result of the aforementioned action. English speaking or not trains run on tracks and when obstructed by another vehicle a collision would result, even in non-English speaking countries that happens.... |
