The union didn't file a lawsuit against the city council to stop issuing the permit, proving their environmental issue charge is just a ruse.

California follows a protocol of analysis and public disclosure of environmental impacts of proposed projects and adopts all feasible measures to mitigate those impacts. The California Environmental Quality Act makes environmental protection a mandatory part of every California state and local agency's decision making process.

Palmdale was relying on an environmental report done years earlier for an office park. It would have been easy for the union to file a lawsuit alleging that this report was inadequate given the difference between an office park and the proposed use, but they didn't. Why not? Because the IBEW had been trying to strongarm Kinki into agreeing to a card check agreement regarding the unionizing of the workforce. It could care less about the environmental issues.
