Presumptuous reasoning. The regulations and taxation along with the federal government competing against rail with other modes is what led to Amtrak's creation. Much of the deregulation that occurred (extremely belatedly) under the Staggers Act could have forestalled the creation of Amtrak and reversed the abandonment of passenger service by private companies, and even forestalled the utterly-unnecessary creation of Conrail.
