The rule used to be if you were under 6, you got a free ride. But even years ago, when bus operators attempted to enforce the fare (and I understand why nowadays, they do not), they'd let a kid was exactly 6 ride for free.

But how do you verify age? Some sort of easily verifiable standard was needed. I don't know when the rule was changed to 44 inches. But it's reasonable. Again, it goes back to the growth spurt issue- maybe at 5'9" and a few days short of 45 y.o., I should ride with my mother and she can tell the NYCTA personnel that I'm 5, I just look mature? Obviously, a deliberately ridiculous argument, but my point is that you need an easily verified rule.

If your 4 or 5 year old really is just huge for his age, take it as a blessing- maybe he'll get a pro sports contract, or at a minimum, he'll be able to deal with school bullies. Both can be good things.
