Id have to go for improper sealing. I'd have a serious chat with the contractor & have him fix the problem or spend years in litagation. When the MTA has a situation that can have blame assessed (remember Pullman-Standard) the contractors ass will be in court for the forseeable future.As for the water table rising, in that short period of time the rising, if any, would be miniscule to say the least. That arguement won't hold any water. (sorry) |
