They cannot stop anybody from using transit, however if you are a criminal and thus banned from transit, all you would be doing is committing another crime for which you can be charged. Lawyers *like* big long rap sheets to take into court, because they will earn more money if they have more to argue and bargain about.
In the end, they either bargain that one off and get to keep the ones they wanted in tact, or they add a year to your sentence to an over-crowded prison thus releasing some other, perhaps worser criminal to the streets (and subways).
