In the section of Amtrak's published Terms of Transportation related to the carriage of passengers, it states: "Amtrak may refuse to carry passengers . . . [w]ho refuse to consent to Amtrak security inspections of persons and/or baggage onboard Amtrak trains and/or at designated areas, such as train platforms and passenger boarding or waiting areas."

Note that the condition imposed is consent to Amtrak security inspections, not TSA security inspections. It would appear that only if TSA were acting as Amtrak's agent would refusal to consent to a TSA inspection trigger the Terms of Transportation as a basis for denial. And in such case, it would be Amtrak that would be denying transportation pursuant to its Terms of Transportation; TSA would not be denying transportation based on their authority.
