It is common knowledge that every state has its own gun possession laws. The prosecutor and defendant should settle on a misdemeanor plea bargain with no jail term. IIRC that's what happened with the TN woman who brought a gun to the WTC. It's a crime but it doesn't deserve jail. |

That would prove the accidental nature as she claims, and put her behind bars if it turns out she lied, by doing it again.Anyone with a handgun permit should understand state laws differ and never take a handgun into another state to begin with. New Jersey has a history of this type of thing; there was a case a few year a where a man was flying with a gun between two airports where the gun was legal and New Jersey arrested him because his flight was diverted to Newark. |

There's no constitutional right to possess a firearm either.The Second Amendment says that a well-regulated militia has the right to keep weapons but it doesn't specify guns nor does it apply to random crazies. I think we can all agree that Timothy McVeigh did not have any right to possess a hydrogen bomb, so obviously the second amendment doesn't grant the right to any weapon and since it doesn't specify guns as permitted, they aren't. They can be legal, of course, but there's no constitutional right to own a gun. |

Stranded gun owners like Revell have the option of going to law enforcement representatives at an airport or to airport personnel before they retrieve their luggage. The careful owner will do so and explain his situation, requesting that his firearm and ammunition be held for him overnight.I would say, whatever you do, refuse to take possession of your luggage. Better to lose use of the luggage for a week than end up with a criminal record. If nothing else, eventually the airline will have to ship the luggage back to your home. |

All depends on how zealous law enforcement feels like about that. About 15 years ago, there was a story in the papers about some guy whose flight got diverted. Someone gave him a package to deliver to someone at his destination. Dumbass TOOK the package from the person and a few minutes later sniffed it and it smelled like weed.Dumbass put it down on a shelf, got on his connecting flight and went home. About a week later, DEA showed up at his door and arrested him under 1073 because the cameras at the airport picked him up putting the package down at the airport. He was sentenced to 3 years and did 1-1/2. So it really all depends ... |
