He wasn't on watch that night, he had a concealed weapons permit, and it wasn't a crime to get out of his car to see where Trayvon had run off to, so he could tell the police when they got there.The state is unlikely to prevail in arguing Zimmerman was the aggressor because to be the aggressor, Zimmerman had to contemporaneously provoke the force Martin used against him. Zimmerman's profiling of Martin and call to the non-emergency number were not contemporaneous with Martin's attack. Even if the state could convince a judge or jury that Zimmerman was following Martin, rather than walking back to his car, rendering his pursuit a contemporaneous act, it is not an act that provokes Martin's use of force against him. Demanding someone account for their presence does not provoke the use of force. Very good. |

I have always advocated that we "wait for the evidence" before condemning Zimmerman. However, I always assumed he was guilty of something. I assumed getting out of the car and following Martin, while not in itself a crime, probably initiated the entire incident. I still believe this. However, I never suspected that a prosecutor would file murder charges against Zimmerman and have absolutely nothing. This is a slam dunk acquittal on self-defense grounds as long as we have an unbiased jury. Since that will be hard, I suggest the defense ask for trial by judge (as is his right). The DA who filed these charges should be disbarred, and she alone is responsible for any violence in reaction to the inevitable exoneration of Mr. Zimmerman.A lot of people on here owe me an apology. I'm waiting ... |

There won't be any more eyewitnesses worth anything because their testimony will be suspect due to the publicity this case has received. The amount of eyewitnesses who will give evidence is fixed to what's in the police report. I'm not sure what else she could have? A videotape of the shooting which directly contradicts all the eyewitnesses?It's also telling there was NO grand jury. In Florida, you don't need them for 2nd degree murder indictments, even if it's standard procedure to call them anyway. |
