According to the New Jersey Law Journal on May 15, Walmart is being sued in connection with a 2010 incident at its Turnersville store in which a racist announcement was broadcast on the store’s public address system.

It was on March 14, 2010 that a male voice announced, “Attention Walmart customers: All black people must leave the store.”

A manager quickly made his own announcement, apologizing for the message, and it was subsequently discovered that a 16-year-old had made the broadcast.

The teenager was charged with harassment and bias intimidation, but now Donnell Battie, who is black, is suing Walmart claiming the store was negligent and reckless and showed deliberate indifference by not keeping the P.A. system safe from abuse, according to the New Jersey Law Journal.

People think I'm nuts but it is not so bad. You can sit in the park and have a coffee and read the newspaper and no one will bother you.

that neighborhood his amazing.

i was in NY a few weeks ago and went to Knickbocker then Onderdonk House. They happened to be having a flea market and when I drove by there were about 30 or 40 bikes chained to the gate outside. They were owned by the hippie population that is taking over that stretch of Bushwick/Lower Ridgewood/East Williamsburg.

It was a fun day.

It could be "deep pockets" syndrome or it could be "lawyer wanting to make a name for himself" syndrome.

The article doesn't say what the damages being pursued are, and it is hard to imagine what Mr. Battie could actually claim his damages were.

From the little information that is given, this has all the makings of a guilty verdict with a judgment of $1 (or even zero) to the plaintiff.

That could be true, but I guess I don't think anyone is that altruistic to put the time and effort into a lawsuit without financial gain.

Sometimes people just mill around until someone gets to them, whether it's some family member, a friend or some ambulance chasing attorney, whispering "you could collect on this" or "you should sue".

Yup.

Clicking through some of the links in the original link can get you to a copy of the actual lawsuit. He is apparently suing for $1 Million, claiming that he suffered "severe and disabling emotional and psychological harm, resulting in depression, anxiety, anger, loss of sleep, loss of appetite, paranoia, anti-social tendencies, and loss of enjoyment in life activities." Mr. Battie claims to have required medical care for these issues and that he will continue to require medical care for these issues.

OK, I thought that the kid worked for them but this scenario makes more sense. It's like when we were in high school kicking in the conductor's booth on the R27-30's and 32s and making phony announcements on the PAs. Of course I never did no such thing!;) And if we were to ever get caught by the police I would bet that my parents or an ambulance chaser would not have initiated such a nonsensical lawsuit.

Wow...so now...Olgia..you're calling this issue "frivolous" because it was not directed at Whites in the Wal-Mart store? is that it? you have this pattern of late about what you deem as racist and what is not. I know you claim that you have a "wealth" of knowledge of some sort, but at times you miss the point what the issue at hand and the racist overtune. If the teen said..."everyone out of the store" the matter would be COMPLETELY DIFFERENT. But because the teen FOCUSED on ONE segment of American society, then there is an issue as to why is was done that way and no other way.

I am sure that might happen. But the concern/issue is the liability on the Wal-mart that they SHOULD BE SECURING their communication devices from the public. What is the teen said there was a fire and everyone rushed all at once to the doors. Someone gets crashed/killed because of foolishness.
