Gays can't say discrimination when it is perfectly legal for them to marry just like straights. And straights can't have a same sex marriage so where's the discrimination?

For all those who claim gay marriage will destroy the institution of marriage, divorce has done a pretty good job of destroying the institution of marriage already.

My view is it's a civil rights issue, the various religions can do what they want, however they need to take a hands off from the states should do.

Probably not very long. The two chicks in the first marriage in either SF or Massachusetts (I don't remember which) broke up 6 months or so after their ceremony.

Not to mention that guys already struggle with monogamy. There will be two guys in gay marriages. You do the math. ;)

How could they? I don't believe that there are any lower courts that can overturn the California supreme court. They are appealing the ruling, but the supreme court is it. California has to amend the constitution if it wants to ban gay marriage. That's all there is to it.

I'm not talking about a lower California court overturning a California supreme court ruling. I meant a court in another state. Not that a supreme court in say Oregon can overturn a California ruling. My understand is that if 1 state allows same sex marriages, it has to be allowed in the the other 49 states.

Eventually this thing will go all the way to the US supreme court in Washington DC.

How can they declare the amendments unconstitutional? If you change the Constitution, you can make all sorts of crazy laws!

If you mean issues under the US Constitution, ultimately, yes. But the state supreme courts have every right to interpret the US Constitution in cases before them that raise such issues. Their judgments may then be appealed to the US Supreme Court.
