You can certainly say that the US system of justice is defective in that it didn't convict Ayers. But given that he's never been convicted of anything, how does his background matter? Obama is a classic example, as are Alicia Keyes and Halle Berry. Historically, Frederick Douglass and Booker T. Washington fell into this category. On the other hand, mixed-race people who were raised by both parents tend to be more relaxed about racial issues and identify themselves as mixed. Derek Jeter, Jason Kidd and Jordin Sparks are examples. It's hard to say how mixed-race people with black mothers identify, as there are relatively few of them.
