Federal Judge bans pride flag displays

A federal judge has upheld a ban on gay pride flags after a years-long battle by an all-Muslim city council to remove the rainbow because it did not reflect their community’s values.

The court found that Hamtramck, an enclave surrounded by Detroit with a significant Muslim immigrant population, did not violate the US Constitution when it banned the flag from public buildings in 2023.US District Judge David Lawson, who was appointed by Bill Clinton, dismissed a lawsuit that was brought against the city for its flag restrictions.

Hamtramck has a population of around 27,000, and more than 40% of its residents are immigrants. A large proportion of them are Muslim with Yemeni or Bangladeshi descent….

The gay flag isn't an official government flag, so the gays don't have a leg to stand on.

In Oregon there was a big deal over this very same issue. The results are far different.

“I believe that even though there are still many struggles happening right now around the country, especially with the transgender and gender non-conforming communities, this is a step forward to show that Newport is a progressive city,” Newport Pride Executive Director and Co-Founder Daniel Cano Restrepo said. “It’s not only going to benefit our community but the surrounding communities as well to show that Newport is the way forward.”

However, the reason behind establishing a policy was a legal concern for the city, triggered by a Supreme Court case that ruled the city of Boston had violated the first amendment when it denied to fly a Christian flag but lacked a policy in place establishing the city’s right to do so. The court ruled municipalities would have to allow their citizens to fly any flag on their municipally-owned flag poles because, without a policy specifying otherwise, the poles would be classified as a forum for citizens’ free expression.
