Birthright citizenship is enshrined in the Constitution. Even babies born on airplanes flying over US airspace are American citizens. The only requirement is that the parents obtain a birth certificate from the approximate municipality, US state, or territory the plane was over at the time of birth This applies even if the aircraft did not take off or land in the US (e.g., a Mexico-to-Canada flight), and, yes, this has actually happened. |

The Fourteenth Amendment defines birthright citizenship for all persons born in the US, whether they were former slaves or not.
