NYPD Officer Faces May Trial In Eric Garner Chokehold Death

New York - A New York City police officer accused in the chokehold death of an unarmed black man will face an NYPD disciplinary trial next May — nearly five years after the man's pleas of "I can't breathe" became a rallying cry against police brutality, an administrative judge said Thursday.

The judge rejected demands from Daniel Pantaleo's lawyer to delay the officer's department trial in the death of Eric Garner until July, when time runs out for federal prosecutors to file civil rights charges against him.

The NYPD trial will start May 13 and could take about two weeks, the judge said.

Pantaleo, who is white, is charged with reckless use of a chokehold and intentional use of a chokehold in Garner's July 2014 death in Staten Island.

Garner, a 43-year-old father of six, could be heard on an amateur video shouting "I can't breathe!" as Pantaleo placed him in an apparent chokehold, which is banned under police department policy, after officers stopped him for selling untaxed cigarettes.

If convicted, the 33-year-old Pantaleo could face punishment ranging from the loss of vacation days to firing from the department. He was stripped of his gun and badge and placed on desk duty after the incident.

Pantaleo's lawyer, Stuart London, said the officer used a takedown move taught by the police department, not a banned chokehold, and will be vindicated. After a brief hearing, his union issued a statement blaming the 350-pound Garner's poor health and resisting arrest for his death.

Pantaleo, wearing a dark suit, didn't speak during the brief hearing at police headquarters and lingered in the trial room with his head down as a crowd, including Garner's relatives, emptied out.

"I felt sort of numb being in the same room as my son's murderer," said Garner's mother, Gwen Carr. She wants the police department to fire Pantaleo and others who were involved in her son's arrest.

Garner, who had asthma, suffered a heart attack in an ambulance and was pronounced dead at a hospital. The medical examiner ruled his death a homicide caused in part by compression of his neck from a chokehold.

A grand jury declined to indict Pantaleo in December 2014. The police watchdog agency prosecuting the disciplinary case, the Civilian Complaint Review Board, is seeking transcripts of that proceeding.

Pantaleo's union, the Patrolmen's Benevolent Association, said Thursday Pantaleo had used "the least amount of force necessary" and that Garner's autopsy showed that his windpipe, which could've been crushed by a chokehold, was intact.

"This case demonstrates the danger that is inherent in prejudging incidents absent all of the information that must be considered in order to come to a truthful and accurate conclusion," Union president Patrick Lynch said in a statement.

Lynch then attacked Garner's health, saying it was so poor that it was "highly likely" he would've died if he had decided to flee police instead of refusing to be handcuffed. "The exertion and stress would have overcome his already seriously ill body and would have resulted in his death," he said.

The NYPD decided in July to go forward with disciplinary proceedings, saying it was running out of patience with the federal government's indecision about whether to bring a criminal case. The Justice Department said it already told the NYPD last spring that it could go forward.

Police Commissioner James O'Neill, who has the final say on officer discipline, said Monday: "We want to get this done."

Total Kangaroo Court. Not even a court per se but I'm means by the NYPD to punish or exonerate cops. They operate on preponderance of the evidence, not guilty or Innocent by Reasonable Doubt. Which means if the right phone calls get made, someone either hangs or they walk. Can you guess what's going to happen?

Let me put it to you another way: If I, an ordinary civilian, did to someone what Pantaleo did to Garner, and it was captured on sharp, clear video, could I expect to get away with it, as Pantaleo has so far?

He was a terror in that neighborhood and pain-in-the-ass number one! Shit, when this first happened and I heard his name I'm like this motherfucker?! They operate on preponderance of the evidence, not guilty or Innocent by Reasonable Doubt.

All employers at best operate on that when deciding whether or not to fire you. Bad employers just fire you based on whim.

If the preponderance of the evidence indicates that Officer Pantaleo used a procedure forbidden by the department, he deserves to be fired.

But that's not how it works in the NYPD trial Room. Everybody, both good and bad, gets phone calls and whoever gets the highest phone call with the biggest hook, wins. In this case, the bigwigs want him fired and Jesus Christ Himself can't come down from heaven and save him.

Kinda hard to dispute the video, don't you think?

All the department needs to do is put a use of force instructor from the Academy on to dissect the video, frame by frame.

BITS uses Academy instructors in the FDNY/EMSC trial system, and for the same reason, as expert witnesses.

There is an element of truth to that. I had a friend who was a cop in one of the Brooklyn precincts, but he had the highest hook of all. His mother was the SPAA in Commissioner Kelly's office. My friend was assigned to the Ice Auto in Prospect Park one dark winter night, and somehow managed to drive his radio car into the pond.

The powers that be wanted to give him more than a CD for that bit of silliness, but his mom had the PC's ear. She went in to see him, and began, "Ray, I know you got to rip him, but he's my son..."

He came away with a nastygram in his file, but that was the end of it. I doubt, however, that Pantaleo has any family on the 14th floor...

Oh, it's more than "an element" If it's
determined by the powers that be that someone has to fall on the sword, whether they are innocent or not, so be it. Same with eing found not guilty.I remember that incident.

AGAIN, the Staten Island ME ruled that Garner died, a homicide victim, from manual compression of his chest and trachea. That is, he died because another human being cut Garner's air off until he asphyxiated. The responding EMS crew sealed Garner's fate by utterly failing to do their jobs. Garner's health was listed by the ME as a secondary cause of his death.

You oughta pay for repeating the lie that this wasn't so.

I have no doubt he was in ill health and that his airway wasn't completely closed. But even partial deprivation of oxygen can have very bad consequences.

10 years ago, at age 57, I was pushing a lawn mower uphill wearing a mask to avoid breathing too many allergens. I suddenly started to experience angina for the first time ever (and I never have since).

My doctor told me that because of the reduced oxygen I could have given myself a heart attack if I hadn't immediately stopped exercising. And I wasn't and am not overweight.

Could he have been propped up to a sitting/standing position after he was cuffed? Sure. Have police and EMS heard the "I can't breathe" mantra over and over again? Yes. Was Eric a known menace and recidivist? Yes. That combination caused his swift death to that Great Cigarette Carton in the ground.

According to the protocol, a patient stating difficulty in breathing is considered an ominous sign of respiratory distress. The words, "I can't breathe", followed by cardiopulmonary arrest, should suggest to even the most ignorant observer that something is seriously wrong.

Gross obesity cannot possibly be the problem if someone is manipulating your airway in a manner likely to cause death. I realize you are completely incapable of believing the police could kill a person this way, or that a Republican DA would intentionally throw a case to maintain a good working relationship with those very same cops, but that is REALITY.

Why would the ME cite manual airway compression as Garner's primary cause of death if that was untrue? The ME has nothing to lose, no matter what diagnosis he makes.

In order to suffer complete cardiopulmonary failure, a person's airway must be compressed to the point where the volume of air entering it is no longer sufficient to sustain breathing. For most people, that means a 90% obstruction.

I will grant for the moment that Garner's ill health may have caused him to suffocate with a less compromised airway, but that still doesn't change the fact that Garner died because his trachea was being forced shut. That shouldn't ever have occurred to begin with.

Yes, but in the Garner case, it wasn't necessary to kill him in order to effect the arrest. It was a very minor offense, one which should have been fairly easy to handle. One sentence of ten words--"Look, this isn't the end of the world, let's go"--would have changed everything. I've talked EDP's out of jumping off the roof with language like that. You get the person to go along with you by convincing them the situation isn't that bad, not by choking the living life out of them.

If I did what Pantaleo did, I'd expect to be charged with aggravated assault, at a minimum. Pantaleo got away with it because of a friendly DA.

Nobody tried to kill him and nobody wanted to kill him. Except for Garner himself, who would have been alive longer* had he not resisted arrest. Did you watch the video? The guy was telling the cops how sick he was that they were arresting him all the time (justifiably, I might add), and when the video starts, they were already arguing for some time.

*Given his abysmal health, it is unlikely, but possible, that he’d have still be alive today.

You fail to want to see reality in this case. He was not asfixiate it by means of choking to death, his Airwaves closed on m-22 is Moberly obese weight. The bottom line is, he's dead and there's no bringing him back! And he caused his own fate.

Bad comparison, because Garner was not a psycho. He was a pain in the ass each and every time police had contact with him. And he also resisted many times as well. Like I said before, this wasn't a random contact. He knew who the cops were, the cops knew who he was, the store owners knew who he was. Sometimes you just have to say to yourself, he brought it all upon himself the world is a better place with him not in it.
