How many lacrosse players have been nominated to the Supreme Court lately?

This isn't a court of law thing. It's a qualification to make decisions that can destroy lives and livelihoods of citizens of this country. A nominee cannot have clouds over their reputations. We made that mistake twice in the past 30ish years as it is. We cannot provide a seat to a third unqulaified person.

True story - back in 2007 I was getting ready for bed when I was hit with abdominal pain so severe I doubled over in pain. My wife, a former 20-year critical care nurse, rushed me to a local teaching hospital. After sitting in chairs for 30 minutes while she checked me in, a nurse triaged me and I was rolled in a wheelchair to an examining room. A few minutes later a doctor came in and examined me; said he'd order a shot of Demerol to relieve the pain; and run some tests.

I got my shot and about 15 minutes later a lab tech came in and drew blood. I waited. And waited. And waited. I could hear the doctor in the rooms on either side of mine examining homeless patients with sore throats. At this point I had been there close to 3 hours and hadn't seen the doctor again. I was feeling somewhat better and walked up to the nurses station and asked why the doctor hadn't been back to see me. Waiting for test results, was their answer. I asked them to please check if they were back and Surprise! they were already there.

The doctor came in about 15 minutes later and told me I had probably had a gall bladder attack. I asked why it took 3 hours for him to get back and he tells me about the other patients. I ask him since when does a middle-age patient with sever abdominal pain take a back seat to a patient with a sore throat? He starts giving me a bullshit excuse and I ask him to get out; I'll see my surgeon tomorrow and I'm leaving. He advises against it and my wife - who is mad enough to chew nails at this point - tells him to either sign discharge orders or we're leaving AMA (Against Medical Advise).

He signs and we leave. Two weeks later I had my gall bladder removed...at a different hospital.

Senate GOP makes counteroffer to Kavanaugh accuser with Friday deadline

The Senate Judiciary Committee is giving Christine Blasey Ford's attorney until the end of the day Friday to work out terms of next week’s proposed hearing on Ford’s allegations that Supreme Court nominee Brett Kavanaugh sexually assaulted her, according to a Republican senator.

The GOP is offering to hold the hearing on Wednesday after Ford sought Thursday and is meeting some of her requests but not others, the senator said. The senator added that Republicans are not inclined to agree with Ford’s lawyers that she should only be questioned by lawmakers — not an outside counsel.

“We’ll do it on Wednesday, we expect the accuser before the accused, and we do intend to have the counsel do the questioning,” the senator said, summing up the Republicans’ stance.

The party is assenting to two of the terms Ford’s lawyers laid out in a Thursday evening call with staff from both parties, the senator said: limiting the hearing to one camera and ensuring that Kavanaugh is not in the same room as her.

GOP members of the Judiciary Committee held a conference call on Friday morning to discuss how to respond to the requests from Ford’s lawyers. But several elements of their offer appear to be nonstarters with Democrats and Ford’s camp, which had made clear that she could not be in the capital to testify before Thursday, according to a senior aide to the minority.

“They’re making this disingenuous counteroffer knowing she won’t be here,” the Democratic aide said.

The GOP has been told that Ford does not want to fly from her California home to Washington, according to the Republican senator, which means she may need to drive across the country to make the hearing. Ford has reportedly told friends she is uncomfortable in confined spaces, indicating a physical difficulty in making the trip by plane.

Republicans have discussed using an outside counsel to question Ford, potentially a woman, to avoid the potentially painful sight of their 11 male Judiciary Committee members grilling Kavanaugh’s accuser in an echo of the 1991 Anita Hill hearings.

But one Judiciary panel Democrat, Rhode Island Sen. Sheldon Whitehouse, immediately dismissed the prospect that only outside counsel could question Ford at the hearing. “I have a constitutional duty to advise and consent,” he said in a statement. “That means asking questions of a nominee for the Supreme Court who has been credibly accused of sexual assault.”

Barring new revelations at the potential Ford hearing, the party plans to vote on Kavanaugh’s nomination in the Judiciary Committee shortly after hearing her testimony next week. And President Donald Trump joined many senior Republicans Friday in launching a heated defense of their Supreme Court nominee.

After a week of holding back, Trump disputed the credibility of Ford's sexual assault allegation against Kavanaugh on Twitter on Friday. The comments panicked Republicans who had welcomed Trump's restraint about a scandal that threatens to bring down his Supreme Court nominee, but they haven’t yet definitively soured the GOP’s upper ranks on Kavanaugh.

Yet Sen. Susan Collins (R-Maine), a critical undecided swing vote on the nomination, said she was “appalled” by Trump’s response and urged her fellow Republicans to try to “make this as comfortable a process for [Ford] as possible.”

"We should try to accommodate Professor Ford within the realm of reasonableness,” Collins told reporters in her home state. “My advice to the Senate leaders is she has said she could be there on Thursday and that we should offer her Wednesday or Thursday. I don't think it's critical as long as it happens next week."

Trump's speculation about why Ford didn't report the alleged high school-era assault if it “was as bad as she says" comes just hours after a close Kavanaugh ally sought to implicate another classmate of the nominee and Ford in the attack on her — a Kavanaugh exoneration theory hotly anticipated by the GOP that landed with a deafening thud.

The one-two punch of Trump and prominent conservative lawyer Ed Whelan's unsuccessful attempts to undercut Ford and boost Kavanaugh leaves the GOP effort to confirm the 53-year-old appeals court judge in fresh peril. It caps a week of roller-coaster talks over whether his 51-year-old accuser, a California-based professor, will testify publicly.

Trump had steered clear of passing judgment on Ford's allegation all week, giving Judiciary Republicans political space to hear out Ford before pressing ahead, but then previewed his Friday morning line of attack on Thursday night.

"I don't think you can delay it any longer. I think they have delayed it a week already," Trump said of the committee's confirmation process.

Some Republicans said their party’s hand in talks with Ford’s lawyers was weakened by the president’s broadside, given the lack of compassion it showed toward an alleged victim.

“The issue is that the compassion component is now turned on its head because you have the president filling the airwaves with something that is not compassionate,” said a plugged-in former Republican leadership aide.

That Republican said he was still confident Kavanaugh will be confirmed, but the aide admitted it just became more challenging for GOP leaders: “It obviously makes their job more difficult, but I think they are capable of doing it.”

But a Republican close to the confirmation process described Trump's comments as a necessary shift of tone to put the White House back on offense for Kavanaugh: “This is getting ridiculous. The president had to step in."

Trump’s earlier relatively low-key stance toward Ford’s allegations had helped the Senate GOP from facing questions about an often inconsistent president.

“He’s still been tweeting, but not about that,” said Senate Majority Whip John Cornyn of Texas earlier this week. “I think he recognizes this is something the Senate has to work out. It’s not really something that he has that much control over at this point.”

But Senate Majority Leader Mitch McConnell (R-Ky.) on Friday sought to calm his party’s nerves amid Trump’s tweets.

"You've watched the fight, you've watched the tactics, but here's what I want to tell you: In the very near future, Judge Kavanaugh will be on the United States Supreme Court," McConnell told conservatives gathered at a summit in Washington. "Keep the faith, don't get rattled by all of this, we're going to plow right through it and do our job."

Trump also took to his favorite social media platform to torch Sen. Dianne Feinstein (D-Calif.) for holding onto Ford’s July letter sharing her story “only to release it with a bang after the hearings were ᴏᴠᴇʀ — done very purposefully to Obstruct & Resist & Delay. Let her testify, or not, and ᴛᴀᴋᴇ ᴛʜᴇ ᴠᴏᴛᴇ!”

Feinstein has defended her decision to keep Ford’s letter from even her fellow Democrats until a media leak forced their hand on a referral to the FBI. She contended that she had no effective avenue to probe the allegation without violating Ford’s request for confidentiality. The FBI has added Ford’s letter to Kavanaugh’s background file but not opened any new investigation, much to Democrats’ frustration.

Adding to the drama, however, was the bid by the judge's friend and influential conservative Whelan to clear Kavanaugh's name. Whelan, president of the right-leaning Ethics and Public Policy Center, had heavily forecast new information about Ford's allegation that emerged as a series of tweets trying to blame another man — who supports Kavanaugh — for the alleged assault.

The Senate GOP had been in touch with Whelan about his theory, and though they were unaware of the details there was some excitement that Kavanaugh's name could be cleared this week. Whelan's attempt backfired spectacularly and he sought to apologize for it on Friday.

"I was very surprised to see it happen the way it did. I thought there was like, you know, a plan," said one Republican aide. "The timing and method of dispersing the information was way past underwhelming.”

Republicans had been looking to Whelan as a credible defender of Kavanaugh's, given his central position in defending the president's nominees and advocating for a more conservative court. People working to confirm Kavanaugh said Whelan's credibility is now shot.

Democrats, for their part, see any potential hearing next week as an opportunity to get more details on whether Kavanaugh as well as other Senate Republican offices conferred in advance with Whelan on his misguided exoneration attempt.

But Kavanaugh’s defenders continued to support the nominee. More than 70 women who have known Kavanaugh at various points in his life crowded a stage at the JW Marriott in Washington on Friday, adamantly dismissing the allegation as contradictory to his character.

One of the women, Meghan McCaleb, said she would hang out with Kavanaugh nearly every weekend in high school and that Kavanaugh dated her sister and some of her closest friends. McCaleb said she tangentially knew Ford through mutual friends. Though McCaleb did not say Kavanaugh and Ford were never at a party together, she did say she never remembers being at party with Ford, who was in another social group.

Grassley panel scraps Kavanaugh hearing, warns committee will vote without deal

The Senate Judiciary Committee is postponing a high-stakes hearing set for early next week on the sexual assault allegation against Supreme Court nominee Brett Kavanaugh.

The committee announced on Friday that the Monday hearing — where both Kavanaugh and his accuser, Christine Blasey Ford, had been invited to speak — was being called off.

Instead, Grassley said in a statement Friday that he is giving Ford’s lawyers until 10 p.m. on Friday to respond to the GOP request for her to testify on Wednesday. If they do not, or if Ford declines to testify, Grassley said the Judiciary Committee will vote Monday on Kavanaugh's nomination.

“I’m providing a notice of a vote to occur Monday in the event that Dr. Ford’s attorneys don’t respond or Dr. Ford decides not to testify. In the event that we can come to a reasonable resolution as I’ve been seeking all week, then I will postpone the committee vote to accommodate her testimony. We cannot continue to delay,” Grassley said in a statement.

The announcement comes after lawyers for Ford and Judiciary Committee staffers struggled to reach an agreement on holding a hearing.

Lawyers for Ford said Thursday that she would not testify during the public hearing that Senate Republicans had set for Monday.

Instead, the two sides have been locked in a 24-hour back-and-forth over the terms of a potential hearing.

“She wishes to testify, provided that we can agree on terms that are fair and which ensure her safety,” Ford’s lawyer, Debra Katz wrote in requesting to talk with Judiciary Committee staff about such “conditions” for the testimony.

Ford’s lawyers pitched Judiciary Committee staff during a separate call about the potential setup for a hearing, including floating Sept. 27 as an alternate day for a hearing. Attorneys for Ford asked that Kavanaugh not be in the same room as the judge and that Kavanaugh testify first.

Republicans on Friday made a counteroffer including that the hearing take place on Wednesday and that Kavanaugh testify after Ford.

Democrats lambasted the GOP maneuver, arguing they were trying to “rush” Ford into testifying and were repeating mistakes from the 1991 Anita Hill hearings.

“We fear that rather than learning from the past, Senate Republicans and the Trump Administration are repeating this Committee’s previous mistakes and making new ones. Up to this point, the Committee majority’s treatment of Dr. Ford has unquestionably been worse than the disgraceful treatment that Anita Hill received 27 years ago,” Judiciary Democrats wrote in a letter to Grassley on Friday.

Republicans are under public pressure from President Trump, who broke his silence on Ford Friday, and urged senators to move forward with Kavanaugh's confirmation even if Ford would not testify.

“I have no doubt that, if the attack on Dr. Ford was as bad as she says, charges would have been immediately filed with local Law Enforcement Authorities by either her or her loving parents. I ask that she bring those filings forward so that we can learn date, time, and place!” Trump said in a string of tweets.

He added in a subsequent tweet that, “let her testify, or not, and ᴛᴀᴋᴇ ᴛʜᴇ ᴠᴏᴛᴇ!”

But the inability to reach a deal with Ford forced Republicans to decide to cancel the hearing or let Kavanaugh testify alone, something which GOP senators were skeptical Grassley would ultimately force the nominee to do.

Sen. Susan Collins (R-Maine) told a Maine radio station this week that she didn’t expect the Monday hearing to take place if Ford refused to testify. Grassley also questioned if a Kavanaugh-only hearing would be “fruitful.”

“What would be the purpose of the hearing if Dr. Ford doesn’t want to respond?” Grassley said Tuesday on "The Hugh Hewitt Show."

Kavanaugh, who has denied any wrongdoing, has been at back-to-back sessions at the White House this week to prepare for a potential hearing and privately told senators on Sunday that he wanted to testify.

But a high-profile hearing could carry risks for both Kavanaugh and Republicans. GOP leadership is heading toward a midterm election in November where they are fighting to keep control of Congress and have worried that female voters could turn against them in several key races.

Meanwhile, Democrats could use a televised setting to lambast Republicans for their handling of Ford’s accusations. Though Republicans have said that Ford should be able to speak, they’ve also come under fire for accusing her of being “mixed up” and questioning if her story is credible.

A public hearing would also let Democrats turn Kavanaugh into a pińata—questioning him on everything from his behavior as a teenager, to his personal life and relitigating if he lied to senators during his initial days-long hearings earlier this month.

The decision to cancel Monday's hearing comes less a week after Grassley bowed to intense pressure and announced that the panel would hold a public hearing.

GOP leadership faced calls from multiple factions of their caucus who warned that they wanted to hear from Ford before moving forward with Kavanaugh's confirmation.

Ford came forward with her allegations publicly in The Washington Post on Sunday. She alleges that during a high school party in the early 1980s, Kavanaugh pinned her to a bed, tried to remove her clothes and covered her mouth when she tried to scream.

Kavanaugh has repeatedly denied wrongdoing, saying he has "never done anything like what the accuser describes — to her or to anyone."

Republicans had been discussing how to maintain control of the optics of a hearing with Ford early next week had she agreed to testify, even weighing the possibility of bringing in outside counsel to question her.

There are no female GOP senators on the committee, something that had drawn comparisons to the all-male Judiciary Committee that questioned Anita Hill during her 1991 testimony against then-Supreme Court nominee Clarence Thomas, who she alleged had sexually harassed her.

Democrats have largely been hands off about publicly demanding that Ford testify, instead backing her calls for the FBI to investigate her allegation saying that the decision is up to Ford.

“Senate Republicans are attempting to make Dr. Blasey Ford testify on just a few days’ notice — without having the FBI follow up on her allegations and provide a report first. This strikes us as simply a check-the-box exercise in a rush to confirm Judge Kavanaugh,” eight Senate Democrats wrote in a letter to President Trump on Thursday.

Ford’s allegation marked the biggest threat to Kavanaugh’s nomination since Trump announced him as his pick to succeed Justice Anthony Kennedy in early July. And even without a public hearing, it’s raised new questions about whether any Democrats will ultimately support him after three backed Neil Gorsuch, Trump’s first Supreme Court pick, last year.

Republicans have a 51-seat majority in the Senate. They can afford to lose one GOP senator before they need to lean on Democrats for help confirming Kavanaugh.

Several GOP senators remain undecided in the wake of the sexual assault allegation. But key swing votes, including Collins and Jeff Flake (Ariz.), appeared to signal this week that Ford needed to publicly testify on Monday.

“I think it’s not fair to Judge Kavanaugh for her to not to come forward and testify,” Collins said on Wednesday.
