That depends on how you read the remark. The Supreme Court did not rule on O'bummercare in total. They just ruled on the issue of the "individual Mandate". In reality, the entire law has not been judged by the Supreme Court so one could still believe that it could be unconstitutional. Of course the remark, on it's face, is unfortunate.
