It's supposed to be an explanation of why the majority interpreted the law incorrectly. Not a rant about how the plaintiff or defendant is going to have a hard time because of the decision.I wouldn't say that only Scalia is guilty of this, but it is an example of an ideological opinion rather than a legal opinion. |
