No, it's because the court as it currently exists is ignoring the Constitution in favor of ideology.Roe V Wade and Brown V BOE would have been decided differently had they applied your criteria. However, I am glad you are now an Originalist. Welcome aboard. Constitutional interpretation is inherently ideological. That's why the SCOTUS exists, to provide the final say on a controversial issue so that there is clarity. |
