The problem is that many people may be intimidated into being forced into arbitration they don't want.True. But many people are intimidated into all sorts of contracts that aren't in their best interests. That's best handled not by outlawing those types of contracts, but by stating that those types of contracts are only enforceable if entered into willingly and with full knowledge of the consequences. It's a very tough area of the law, not just when it comes to religious sects. Are you entering into a brokerage arbitration contract willingly if your only other choice is to not buy stocks? |
