In a very narrow sense, he made the comment about 2 very specific people wo could have legal remedy. However, that comment could also be used to show his mind-set about an entire race given the actual truth about their employment. It certainly would not help his ability to perform his duties and I feel that there is some justification for the disciplinary action.
