This regulation of commerce promotes the general welfare. Congress is mandated with both tasks in the Constitution. An insurance system for healthcare only functions when 100% participate. Since we insist on retaining this leviathan instead of a tax based nationalized system or single payer system, the means for 100% participation must be found, hence the mandate. |
