The First Amendment restricts the states too.An agency of a state is empowered by the legislature of that state to function without further intervention of the legislature. Any of its actions are effectively actions of the legislature of that state. In this case it's two states, but the same thing applies. People are being excluded IF THEIR RELIGION MAKES IT SO THEY CAN'T PRAY IN FRONT OF A CROSS. |
