It went back and forth. I remember the righties here in 2004 or 2005 said that al Qaeda weren't eligible to benefit from the Geneva Convention because they weren't soldiers, didn't wear uniforms, not under a flag etc.

Then they changed it to they WERE soldiers to defend against trying them in civilian courts.

That brings us to now and I would say they are still soldiers.
