This is different as the argument against the plan will be made on states' rights. At every level, the courts will be divided.Similarly, if the feds try to exempt this from lawsuits, that may also be challenged on the same grounds---that the feds are overstepping their authority as per Amendment 10. See here for a discussion on this (I do post there). They are prepared to fight all the way to the US Supreme Court, and I predict that it will be a 5-4 decision with Anthony Kennedy being the swing vote---but which way? |
