However...can McCain get such a judge past Democrats in the Senate? Likely such a nominee won't even get a floor vote (being killed in committee).The Senate is likely to be as much as 60-40 Democrats for the next Congress, more likely 59-41 if Dole can hold off a Democratic challenger. Otherwise, the Democrats have a filibuster-proof Senate. |
