The video that I saw showed the car wheels turned in a way that she probably wouldn't have hit him or he could have easily moved out the way. But it unfolded very quickly and I think that the ICE agents actions were consistent with other police shootings that have been ruled justifiable in California. I don't know how things like this are judged in other places.
