My point is that there is no prior Supreme Court case that requires following if you use the analysis that Justice Alito has used in his opinion. A state like Hawaii could follow the same type of law like Texas did in creating a bounty system in abortion matters but instead of abortions target Judges who are in interracial marriages and make it no defense that Loving made it legal. The Texas law does not allow a defense based on Roe or Casey making the abortion legal at the time it was performed. However, rather than the minimum of $10,000 bounty in Texas, Hawaii makes it $1,000,000,000.00 |
