This is the pertinent bit as "non-violent" is open to interpretation. I don't know all the legal definitions but I've posted examples of 3rd degree assault that most reasonable people would consider to be violent. Just based on what I've read over the last 24 hours, it appears that DA's have a lot of latitude in how to interpret that and can very much influence how cases are charged and prosecuted. In LA we don't even have a law like NY, but our DA was elected by making those same promises.
