But in many instances, it is an end-run around double Jeopardy. That may or may not be a bad thing. In the previously mentioned Lemrick Nelson case, it was a good but wholly unsatisfying 2nd shot at justice. In that case, Nelson was acquitted of killing Yankel Rosenbaum. In the federal case, Nelson was convicted of violating Rosenbaum's civil rights by killing him. He was sentences to 10 years but served less than one due to time served in the prior case. So the case didn't count but the time served did. Justice?
