I'm surprised Alito allowed this challenge to continue beyond Dec. 8th, which is the legal deadline for states to certify their choice of electors. That seems contrary to what was done in 2000 with Bush v. Gore.Precisely. In Bush v.Gore, there was a genuine dispute as to who had the most valid votes in FL. In the law suit at issue here, the Republicans are not claiming that Trump received more valid votes than Biden. The Supreme Court is probably going to decide more precisely what kinds of voting procedures can be changed by executive order and what require legislation. But they're not going to apply it retroactively to people who voted in good faith in PA under rules that were valid at the time. |
