In addition to my previous point, I don't think Chief Justice was too thrilled with the Fifth Circuit Court of Appeals thumbing its nose at the Supreme Court when there was a case directly on point, just like when the Ninth Circus deliberately ignores binding precedents regarding death penalty and habeas corpus matters. Only the Supreme Court can overrule Supreme Court precedent. If a state wanted to cut back Whole Women's Health, they should have not tried to pass the same law and back it up with the same facts that failed previously. |
