He still believes that the majority in Whole Women's Health applied the incorrect standard, but nevertheless felt compelled to vote as he did in this case because stare decisis and that the majority in the first case could be interpreted in a way that is consistent with Casey. Nobody suggested that Casey should be overruled. Louisiana argued lack of standing and that the law was not an "undue burden" under Casey framework. |
