I'm trying to understand the nature of what we're talking about. Is it a law, properly understood (e.g. an act of the legislature?) The memo in question reads that it is issuing "new legal enforcement guidance that defines discrimination." Is that law? Why are we working off a separate document rather than the actual law? Has the law changed, or has it been clarified? Does anyone have the authority to clarify existing law besides the courts? |
